Welcome to Fame Of Name ("we", "us", "our"). Fame Of Name is a marketing and advertising agency based in Australia and India, providing services including but not limited to digital marketing, content creation, social media management, branding, PR, advertising campaigns, analytics, and consultancy.
By accessing our website, engaging our services, or communicating with us, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or services.
1. Services
1.1 Fame Of Name provides marketing and advertising services tailored to each client based on agreed proposals, quotations, or contracts.
1.2 All services are provided on a best-effort basis. While we aim to achieve growth in reach, engagement, footfall, and turnover, we do not guarantee specific results, as outcomes depend on multiple external factors beyond our control (market conditions, client cooperation, platform algorithms, audience behavior, etc.).
1.3 Any timelines provided are estimates unless expressly agreed in writing.
2. Client Responsibilities
2.1 Clients must provide accurate, complete, and lawful information, content, and materials required for service delivery.
2.2 Clients confirm that all materials supplied (logos, images, videos, copy, trademarks, offers, claims, etc.) do not infringe any third-party rights and comply with applicable laws and advertising standards.
2.3 Clients are responsible for obtaining all necessary permissions, licenses, and approvals related to their business, promotions, and advertising claims.
2.4 Delays caused due to late inputs, approvals, or changes requested by the client may affect delivery timelines and outcomes.
3. Payments & Fees
3.1 Fees, payment schedules, and scope of work will be defined in a written proposal, invoice, or agreement.
3.2 All payments must be made as per the agreed terms. Late payments may result in suspension or termination of services.
3.3 Fees paid are non-refundable unless otherwise stated in writing.
3.4 Any third-party costs (advertising spend, influencers, software tools, printing, media buying, etc.) are payable by the client unless explicitly included.
4. Intellectual Property
4.1 All pre-existing intellectual property of Fame Of Name remains our property.
4.2 Upon full payment, clients are granted a non-exclusive license to use final deliverables created specifically for them, unless otherwise agreed.
4.3 Drafts, concepts, strategies, reports, and methodologies remain the property of Fame Of Name unless transferred in writing.
4.4 Fame Of Name reserves the right to showcase completed work for portfolio, marketing, website, and promotional purposes unless the client requests confidentiality in writing.
5. Confidentiality
5.1 Both parties agree to keep confidential information private and not disclose it to third parties, except where required by law or with written consent.
5.2 This obligation survives termination of services.
6. Third-Party Platforms & Tools
6.1 Fame Of Name is not responsible for changes, outages, suspensions, or policy updates by third-party platforms such as Meta (Facebook/Instagram), Google, TikTok, LinkedIn, or other service providers.
6.2 We are not liable for account restrictions, bans, or performance issues caused by platform policies or client-provided content.
7. Limitation of Liability
7.1 To the maximum extent permitted by law, Fame Of Name shall not be liable for any indirect, incidental, or consequential losses, including loss of profit, revenue, data, or business opportunity.
7.2 Our total liability, if any, shall not exceed the total fees paid by the client for the specific service giving rise to the claim.
8. Termination
8.1 Either party may terminate services with written notice as per the agreed contract or proposal.
8.2 Upon termination, all outstanding payments become immediately due.
8.3 Fame Of Name reserves the right to terminate services immediately in cases of non-payment, unlawful activities, or breach of these terms.
9. Governing Law
These Terms & Conditions are governed by the laws of South Australia, Australia, and any disputes shall be subject to the jurisdiction of Australian courts.
